The contents cover diverse topics such as: execution of wills; testamentary capacity and undue influence; the revocation and revival of wills; class gifts and powers of appointment the legal right of spouses and civil partners; s 117 applications unworthiness to succeed and disinheritance the construction of wills; the issue of costs; equitable concepts and doctrines; foreign elements; the duty of care of solicitors; accountability and privilege; gifts taking effect on death; the validity of proceedings; the limitation of actions. Instances of the type of principles, criteria and prerequisites include the Kearns' Principles devised by Kearns J (as he then was) in In the Estate of ABC, XC v RT [2003] 2 IR 250 were derived from previous cases involving s117 applications to the courts by children of testators, the Lowry Principles devised by Lowry LCJ in Heron v Ulster Bank Ltd [1974] N.I. 44 are applied in cases dealing with the construction of wills, the Fennelly Criteria in Corrigan v Martin, Unreported, High Court, Fennelly J, 13 March, 2006, are referred to whenever the provisions of s 9 of the Civil Liability Act 1961 and the periods of limitation for bringing actions against the estates of deceased persons become an issue, and the prerequisites of the equitable doctrine of proprietary estoppel formulated by Laffoy J in Coyle v Finnegan and Finnegan [2013] IEHC 463. Book excerpt: To what extent did Europeanisation contribute to Ireland’s transformation from ‘poor relation’ to ‘peer idol’? This book examines how Europeanisation affected Irish policy-making and implementation and how Ireland maximised the policy opportunities arising from membership of the EU while preserving embedded patterns of political behaviour. It focuses on the complex interplay of European, domestic and global factors as the explanation for the changing character of the ‘Celtic Tiger’. The authors demonstrate that, although Europeanisation spurred significant institutional and policy change, domestic forces filtered those consequences while global factors induced further adaptation. By identifying and assessing the adaptational pressures in a range of policy areas the book establishes that, in tandem with the European dimension, domestic features and global developments were key determinants of change and harbingers of new patterns of governance.

Book excerpt: This is the first systematic study of patterns of social mobility in Ireland. It covers a recent period--the 1960s--when Ireland was undergoing rapid economic growth and modernization. The author thus was able to test the widely accepted hypothesis that growth weakens class barriers. To his surprise he found that it did not. Social mobility increased somewhat, but among mobile men the better jobs still went to those from advantaged social class origins. Despite economic development and demographic change, the underlying link between social origins and career destinations remained unchanged. In chapters on education, life cycle, religion, and farming, Michael Hout shows how inequality persists in contemporary Ireland. In the last chapter he reviews evidence from other countries and concludes that governments must take action against class barriers in education and employment practices if inequality is to be reduced. Economic growth creates jobs, he argues, but economic growth alone cannot allocate those jobs fairly.
