Book Synopsis The Arms Trade Treaty: A Commentary by : Andrew Clapham

Book excerpt: The United Nations Arms Trade Treaty became binding international law in late 2014, and although the text of the treaty is a relatively concise framework for assessing whether to authorize or deny proposed conventional weapons transfers by States Parties, there exists controversy as to the meaning of certain key provisions. Furthermore, the treaty requires a national regulatory body to authorize proposed transfers of conventional weapons covered by the treaty, but does not detail how such a body should be established and how it should effectively function. The Arms Trade Treaty: A Commentary explains in detail each of the treaty provisions, the parameters for prohibitions or the denial of transfers, international cooperation and assistance, and implementation obligations and mechanisms. As states ratify and implement the Treaty over the next few years, the commentary provides invaluable guidance to government officials, commentators, and scholars on the meaning of its contentious provisions. This volume describes in detail which weapons are covered by the treaty and explains the different forms of transfer that the Arms Trade Treaty regulates. It covers international human rights, trade, disarmament, humanitarian law, criminal law, and state-to-state use of force, as well as the application of the treaty to non-state actors.

Book Synopsis The European Union's Involvement in Negotiating an Arms Trade Treaty by : Sara Depauw

Download or read book The European Union's Involvement in Negotiating an Arms Trade Treaty written by Sara Depauw. This book was released on 2012. Available in PDF, EPUB and Kindle. Book excerpt: In July 2012 the United Nations convened a conference to negotiate a legally binding arms trade treaty (ATT) to regulate trade in conventional arms at the highest possible common international standards. Arms export controls can only be effective if implemented at the global level, in a coherent and consistent manner. The European Union (EU) strongly supports the development of a global ATT. The EU coordinated internally to streamline national positions and converge diverging approaches on the content of the ATT. Furthermore, it pleaded for an inclusive process and put this into practice by organizing outreach seminars for all UN member states. However, during the negotiations in July 2012 the EU encountered difficulties in streamlining national policies and fulfilling its ambitious role to act as a global actor. Striking the right balance between effective national diplomacy and EU consistency during the negotiations proved to be challenging. Although UN member states did not reach an agreement in July, the EU has a crucial role to play in future negotiations, which will continue in March 2013.

Book Synopsis Arms Trade and Europe by : Paul Cornish

Download or read book Arms Trade and Europe written by Paul Cornish. This book was released on 1995-03-12. Available in PDF, EPUB and Kindle. Book excerpt: Focusing on conventional weapons, rather than nuclear, biological and chemical ones, this book draws attention to important differences, within the EU, between the trade in finished weapons and the technology used to make them. It examines West European efforts since 1945 to manage both sides of conventional defence-related trade, and the political, industrial, technological and conceptual obstacles to effective mulitlateral co-ordination and regulation. The book argues that, in current European and international circumstances, recent EU initiatives have limited prospects and may prove to be counterproductive.>
