Book excerpt: Data Security Breaches and Privacy in Europe aims to consider data protection and cybersecurity issues; more specifically, it aims to provide a fruitful discussion on data security breaches. A detailed analysis of the European Data Protection framework will be examined. In particular, the Data Protection Directive 95/45/EC, the Directive on Privacy and Electronic Communications and the proposed changes under the Data Protection Regulation (data breach notifications) and its implications are considered. This is followed by an examination of the Directive on Attacks against information systems and a discussion of the proposed Cybersecurity Directive, considering its shortcomings and its effects. The author concludes by looking at whether a balance can be drawn by the current and proposed Data Protection framework to protect against data security breaches and considers what more needs to be achieved.

Book Synopsis Cyber Security, Privacy and Data Protection in EU Law by : Maria Grazia Porcedda

Download or read book Cyber Security, Privacy and Data Protection in EU Law written by Maria Grazia Porcedda. This book was released on 2022. Available in PDF, EPUB and Kindle. Book excerpt: "Is it possible to achieve cyber security while safeguarding the fundamental rights to privacy and data protection? Addressing this question is crucial for European democratic societies, where information technologies have taken centre stage in all areas of communal life. This timely book answers the question with a comprehensive approach that combines legal, policy and technological perspectives to capture the essence of the relationship between cyber security, privacy and data protection in EU law. The book identifies tensions inherent in the EU cyber security policy and its implementation, the reach of cyberspace and its security, the meaning of 'data', as well as the value of privacy and data protection. The book's novel analysis looks at the interplay between the design of the technology implementing the applicable law, such as the GDPR and the NIS Directive, and the layered configuration of fundamental rights in EU law. This original analysis outlines the possible combinations of the relationship between cyber security, privacy and data protection in EU law, from outright clash to complementarity. An essential read for scholars and practitioners of IT law alike, the book demonstrates that reconciliation between cyber security, privacy and data protection relies on explicit and brave political choices, which require deciding what needs to be protected, and how."--

As the world comes to terms with Artificial Intelligence (AI), which now pervades the daily lives of everyone. For instance, our smart or Iphone, and smart home technology (robots, televisions, fridges and toys) access our personal data at an unprecedented level. Therefore, the security of that data is increasingly more vulnerable and can be compromised. This book examines the interface of cyber security, AI and data protection. It highlights and recommends that regulators and governments need to undertake wider research and law reform to ensure the most vulnerable in the community have their personal data protected adequately, while balancing the future benefits of the digital economy.
