Download or read book Preferential Trade Agreements and International Law written by Graeme Baber. This book was released on 2018-12-07. Available in PDF, EPUB and Kindle. Book excerpt: The multilateral trade agreements in the Annexes to the Agreement Establishing the World Trade Organization provide a comprehensive structure for international trade. Why would trading partners in different countries feel the need to go outside this framework in order to set up preferential trade arrangements? This book considers the structure of the World Trade Organization’s agreements and the types of preferential trade arrangements, and deliberates the value of the latter in the light of the operation of the former. Preferential Trade Agreements and International Law offers a comprehensive examination of preferential trade agreements and considers the features of specific regional and bilateral trade agreements without drawing upon systematic features and trends. It shows the latest state of knowledge on the topic and will be of value to researchers, academics, policymakers, and students interested in international trade and economic law.

Book Synopsis Termites in the Trading System by : Jagdish Bhagwati

Download or read book Termites in the Trading System written by Jagdish Bhagwati. This book was released on 2008-07-14. Available in PDF, EPUB and Kindle. Book excerpt: Jagdish Bhagwati, the internationally renowned economist who uniquely combines a reputation as the leading scholar of international trade with a substantial presence in public policy on the important issues of the day, shines here a critical light on Preferential Trade Agreements, revealing how the rapid spread of PTAs endangers the world trading system. Numbering by now well over 300, and rapidly increasing, these preferential trade agreements, many taking the form of Free Trade Agreements, have re-created the unhappy situation of the 1930s, when world trade was undermined by discriminatory practices. Whereas this was the result of protectionism in those days, ironically it is a result of misdirected pursuit of free trade via PTAs today. The world trading system is at risk again, the author argues, and the danger is palpable. Writing with his customary wit, panache and elegance, Bhagwati documents the growth of these PTAs, the reasons for their proliferation, and their deplorable consequences which include the near-destruction of the non-discrimination which was at the heart of the postwar trade architecture and its replacement by what he has called the spaghetti bowl of a maze of preferences. Bhagwati also documents how PTAs have undermined the prospects for multilateral freeing of trade, serving as stumbling blocks, instead of building blocks, for the objective of reaching multilateral free trade. In short, Bhagwati cogently demonstrates why PTAs are Termites in the Trading System.

Book Synopsis The Pacific Alliance in a World of Preferential Trade Agreements by : Pierre Sauvé

Download or read book The Pacific Alliance in a World of Preferential Trade Agreements written by Pierre Sauvé. This book was released on 2018-06-29. Available in PDF, EPUB and Kindle. Book excerpt: This volume focuses on one of the most innovative deep integration constructs, The Pacific Alliance, which aims at expanding the frontiers of trade and investment governance in Latin America. It draws on a conference held at Externado University in Bogota, Colombia, in November 2015, bringing together leading scholars, practitioners and officers of public, regional and international organisations interested in a critical analysis of the Alliance, its distinctiveness and likely future directions. The volume features contributions from the multi-disciplinary lens of law, political science and economics. The Pacific Alliance, comprising Chile, Colombia, Mexico and Peru, aims through a participatory and consensual manner to promote the free circulation of goods, services, capital and persons among its members, and to secure deep economic integration through collaboration across a broader set of policy areas than typically obtains in more traditional preferential trade agreements. This volume is of interest to policy makers and staff of international organizations involved in trade and investment negotiations, international economic governance in general as well as faculty, researchers and graduate students of these topics and of international political economy and comparative regionalism.

Book Synopsis Coherence and Divergence in Services Trade Law by : Rhea Tamara Hoffmann

Download or read book Coherence and Divergence in Services Trade Law written by Rhea Tamara Hoffmann. This book was released on 2020-07-23. Available in PDF, EPUB and Kindle. Book excerpt: This book addresses topical questions concerning the legal framework of trade in services, and assesses how these issues are dealt with in GATS and in selected preferential trade agreements. In addition, the chapters discuss whether the differences and similarities (if any) are evidence of greater coherence or greater divergence. The book combines the individual analyses to provide a more comprehensive picture of the current law on services trade liberalisation.A quarter of a century after the conclusion of the General Agreement on Trade and Services (GATS), international law on trade in services is still in a state of flux: on the one hand, countries increasingly conclude bilateral and regional trade agreements with sections on trade in services that aim at a further liberalisation of services trade. On the other, the GATS structure remains the dominant model and serves as the basis for many preferential trade agreements. In addition, new aspects such as electronic commerce, data protection and taxation are now emerging, while issues that had already manifested in the mid-1990s such as financial services regulation, labour mobility, and telecommunications continue to be problematic. Usually, the debates focus on the question of whether preferential trade agreements serve as a stepping-stone or stumbling block for trade liberalisation at the multilateral level. However, it can be assumed that rules on trade in services in preferential trade agreements will coexist with the global GATS regime for the foreseeable future. This raises the question of whether we’re currently witnessing a drive towards greater coherence or more divergence in agreements on trade in services.
