Book excerpt: This comprehensive and innovative volume focuses on the usefulness and relevance of extending the scope of protections already in place for national minorities ('old minorities') to migrant populations ('new minorities') in Europe. Delving into a highly relevant but under-researched issue, the book examines the feasibility of expanding the system of protection for national minorities to migrant groups, as well as considering issues of diversity, security, socio-economic concerns and identity. Taking a multidisciplinary perspective, and combining insights from political science, law, sociology and anthropology, it asks the central question of how far the extension of policies and rights currently specific to national minorities is conceptually meaningful and beneficial to the integration of ‘new’ minorities. Book excerpt: This third and last open access volume in the series takes the perspective of non-EU countries on immigrant social protection. By focusing on 12 of the largest sending countries to the EU, the book tackles the issue of the multiple areas of sending state intervention towards migrant populations. Two “mirroring” chapters are dedicated to each of the 12 non-EU states analysed (Argentina, China, Ecuador, India, Lebanon, Morocco, Russia, Senegal, Serbia, Switzerland, Tunisia, Turkey). One chapter focuses on access to social benefits across five core policy areas (health care, unemployment, old-age pensions, family benefits, guaranteed minimum resources) by discussing the social protection policies that non-EU countries offer to national residents, non-national residents, and non-resident nationals. The second chapter examines the role of key actors (consulates, diaspora institutions and home country ministries and agencies) through which non-EU sending countries respond to the needs of nationals abroad. The volume additionally includes two chapters focusing on the peculiar case of the United Kingdom after the Brexit referendum. Overall, this volume contributes to ongoing debates on migration and the welfare state in Europe by showing how non-EU sending states continue to play a role in third country nationals’ ability to deal with social risks. As such this book is a valuable read to researchers, policy makers, government employees and NGO’s.

Available in PDF, EPUB and Kindle. Book excerpt: The war in Ukraine has brought about an unprecedented change in the way the European Union addresses migration-related issues. Following the invasion of Ukraine by Russian forces, the Council of the European Union adopted an implementing Decision establishing the existence of a mass influx of displaced persons from Ukraine within the meaning of Article 5 of Council Directive 2001/55/EC and so activating its temporary protection mechanism for the first time. While the Directive's provisions reflect the founding principles of the European Union, the specific vulnerabilities of international migrants require suitable social provisions to afford them a standard of living as appropriate to their health and well-being for the duration of the protection provided by the Directive. The purpose of this article is to discuss the nature of the challenges arising from this first application of the temporary protection directive, the impact of these challenges on the Directive's efficacy and on the extension of the protection for the displaced persons covered by it. It argues, first, that the joint interpretation of the Directive and the Council Decision significantly limits the personal scope of the protection, leaving some categories of migrants behind. The paper then goes on to examine the substance of the Directive and suggests that the broad interpretation of its social protection provisions reveals new difficulties as regards the financing of this protection and its sustainability.
