Book Synopsis The Foundations of European Transnational Private Law by : Anna Beckers

Download or read book The Foundations of European Transnational Private Law written by Anna Beckers. This book was released on 2024-05-30. Available in PDF, EPUB and Kindle. Book excerpt: Since Anu Bradford's groundbreaking book on the Brussels Effect there is a vastly evolving literature on the EU as a global regulatory actor as well as the global reach of EU law. This edited collection connects to this debate. Yet, it shifts the focus from the currently predominant public law focus to investigating European and EU private law and to connecting to literature and research on transnational law. To that end, it proceeds first conceptually by introducing and giving shape to the notion of a “European Transnational Private Law” through four conceptual contributions by the editors. Secondly, it focuses on several sectors (finance, taxation, investment, consumer law, labour law) and topics (climate litigation, global value chains, non-discrimination) to trace sector-specifically the role of EU private law in relation to transnational legal ordering.

Book excerpt: Terms such as 'Social Europe' and 'European Social Model' have long resided in the political and regulatory lexicon of European integration. But in recent years, and in spite of the adoption of the Charter of Fundamental Rights, the EU social profile has entered a profound period of crisis. The ECJ judgments of Viking and Laval exemplify the unresolved tension between the EU's strong market imperatives and its fragile social aspirations while the ongoing economic crisis, while the various 'bail out' packages are producing a constant retrenchment of social rights. The status quo is one in which workers appear to shoulder most of the risks attendant on making and executing arrangements for the doing of work. Chapters in this book advocate a reversal of this trend in favour of fair mutualization, so as to disperse these risks and share them more equitably between employers, the state, and society at large.

Book Synopsis Europe 2020 by : Eric Marlier

Download or read book Europe 2020 written by Eric Marlier. This book was released on 2010. Available in PDF, EPUB and Kindle. Book excerpt: This book attempts to answer the question: "How can Europe 2020, the EU's new strategy for smart, sustainable and inclusive growth, lead to a stronger social EU with less poverty and greater social cohesion?" Examined in depth are achieving the EU's ambitious social objectives to lift at least 20 million people out of the risk of poverty and exclusion by 2020 and the Union's four other mutually reinforcing targets. A key objective of the book is to take a critical look at and draw lessons from the past, 2000-2010 Lisbon Strategy. Another important objective is to explore the format and role of EU coordination and cooperation in the social field in the new EU governance framework, in a context marked by slow recovery after the global economic crisis. Finally, the book also makes proposals for the further reinforcement of this coordination and cooperation and for the improvement of the different instruments available at EU, national and sub-national levels.
