Book Synopsis Pro-Life V. Pro-Death: Abortions and the Supreme Court by : Catherine Jaime

Download or read book Pro-Life V. Pro-Death: Abortions and the Supreme Court written by Catherine Jaime. This book was released on 2015-03-08. Available in PDF, EPUB and Kindle. Book excerpt: Roe v. Wade, Doe v. Bolton, and Planned Parenthood v. Casey - 3 landmark Supreme Court Cases dealing with abortions. Here in one place are important excerpts from all three cases. This book was put together by a conservative lay person for other conservatives. Examples of some of what you will find in the book: "The Constitution does not explicitly mention any right of privacy. In a line of decisions, however, going back perhaps as far as 1891, the Court has recognized that a right of personal privacy, or a guarantee of certain areas or zones of privacy, does exist under the Constitution." From Justice Blackmun's Majority Opinion in Roe v. Wade "The fact that a majority of the States reflecting, after all, the majority sentiment in those States, have had restrictions on abortions for at least a century is a strong indication, it seems to me, that the asserted right to an abortion is not "so rooted in the traditions and conscience of our people as to be ranked as fundamental." From Justice Rehnquist's Dissenting Opinion in Roe v. Wade "Roe v. Wade sets forth our conclusion that a pregnant woman does not have an absolute constitutional right to an abortion on her demand...Further, a physician or any other employee has the right to refrain, for moral or religious reasons, from participating in the abortion procedure." From Justice Blackmun's Majority Opinion in Doe v. Bolton "The common claim before us is that, for any one of such reasons, or for no reason at all, and without asserting or claiming any threat to life or health, any woman is entitled to an abortion at her request if she is able to find a medical advisor willing to undertake the procedure." From Justice White's Dissent in Doe v. Bolton "Viability marks the earliest point at which the State's interest in fetal life is constitutionally adequate to justify a legislative ban on nontherapeutic abortions. The soundness or unsoundess of that constitutional judgment in no sense turns on when viability occurs." From the Majority Opinion in Planned Parenthood v. Casey "The correct analysis is that set forth by the plurality opinion in Webster: a woman's interest in having an abortion is a form of liberty protected by the Due Process Clause, but States may regulate abortion procedures in ways rationally related to a legitimate state interest." From Rehnquist's Minority Opinion in Planned Parenthood v. Casey

Book Synopsis Griswold V. Connecticut by : John W. Johnson

Download or read book Griswold V. Connecticut written by John W. Johnson. This book was released on 2005. Available in PDF, EPUB and Kindle. Book excerpt: Recounts the landmark 1965 Supreme Court case that declared a new and previously unarticulated "right of privacy" and paved the way for the Roe v. Wade decision. Decades later, Griswold v. Connecticut remains extremely controversial as an example of an activist judiciary making new law rather than merely interpreting existing law.

Book Synopsis Women vs. American Supreme Court by : Supreme Court of the United States

Download or read book Women vs. American Supreme Court written by Supreme Court of the United States. This book was released on 2023-12-26. Available in PDF, EPUB and Kindle. Book excerpt: The legality of abortion in the United States is subject to individual state laws. In 1973, Roe v. Wade made the first abortion case to be taken to the Supreme Court, which had made it federally legal. In 1992, Roe was partially overturned by Planned Parenthood v. Casey, which stated that states cannot place legal restrictions posing an undue burden for "the purpose or effect of placing a substantial obstacle in the path of a woman seeking an abortion of a nonviable fetus." In 2022, both Roe and Casey were overturned, and abortions are now subject to regulations based on state laws once again. Individual states can regulate and limit the use of abortion, some of which already have through the use of "trigger laws", which made abortion illegal within the first and second trimesters when Roe was overturned. Eight states—Alabama, Arizona, Arkansas, Michigan, Mississippi, Oklahoma, West Virginia and Wisconsin—still have pre-Roe abortion bans in their laws, which may be enforced too. This reading provides a thorough overview of the federal legalisation regarding the legality of abor-tion. It presents a judicial history and legislative response of the US federal institutions. In addition this collection is enriched with information which are indispensable part of every abortion debate in the United States.
