Book excerpt: This article assesses recent proposals for the reform of cohabitation law by drawing on two interdisciplinary empirical studies. The first, sponsored by the Ministry of Justice, included a survey (n=102) of people who had accessed the 'Living Together Campaign' website; investigating legal awareness, attitudes to cohabitation law, and financial practices. The second, funded by the Nuffield Foundation, included a nationally representative survey (n=3197); investigating attitudes towards marriage, cohabitation, and their legal and financial consequences. Each survey was followed up with semi-structured interviews which explored financial practices, processes of decision-making, understandings of commitment, awareness of and attitudes to current cohabitation law, and possible law reform. In the analysis, we considered cohabitants' practices alongside attitudes to their legal position and the links between finances and commitment; and different 'types' of cohabitation were considered alongside demographic differences in order to explore the legal needs of diverse groups of cohabitants. We concluded that cohabitants in both projects fitted a typology comprising: Ideologues, Romantics, Pragmatists, and Uneven couples; and we considered the current proposals for legal reform in the light of this typology.

Download or read book Great Debates in Family Law written by Jonathan Herring. This book was released on 2015-04-17. Available in PDF, EPUB and Kindle. Book excerpt: This textbook is an ambitious and engaging introduction to the more advanced writings on family law, primarily designed to allow students to 'get under the skin' of the topic and begin to build their critical thinking and analysis skills. Each chapter is structured around key questions and debates that provoke deeper thought and, ultimately, a clearer understanding. The aim of the book is therefore not to present a complete overview of theoretical issues in family law, but rather to illustrate the current debates which are currently going on among those working in shaping the area. The text features summaries of the views of notable experts on key topics and each chapter ends with a list of guided further reading.

Download or read book Cohabitation and Religious Marriage written by Akhtar, Rajnaara. This book was released on 2020-07-01. Available in PDF, EPUB and Kindle. Book excerpt: Cohabiting couples and those entering religious-only marriages all too often end up with inadequate legal protection when the relationship ends. Yet, despite this shared experience, the linkages and overlaps between these two groups have largely been ignored in the legal literature. Based on wide-ranging empirical studies, this timely book brings together scholars working in both areas to explore the complexities of the law, the different ways in which individuals experience and navigate the existing legal framework and the potential solutions for reform. Illuminating pressing implications for social policy, this is an invaluable resource for policy makers, practitioners, researchers and students of family law.

Book Synopsis Marital Rights by : Robert Leckey

Download or read book Marital Rights written by Robert Leckey. This book was released on 2017-07-05. Available in PDF, EPUB and Kindle. Book excerpt: This volume gathers influential and cutting-edge scholarship on the international and domestic rights attaching to married couples and other adult relationships. Addressing examples from the European Court of Human Rights, UK, USA, Canada, Australia and South Africa, it traces contentious debates about the content of marital rights and responsibilities and whether law should reach beyond marriage, and if so how. Twenty-four essays and a substantial introduction highlight the complexity and contradictions as marital law grapples with gender equality, the aftermath of recognizing gay and lesbian rights, abiding economic inequalities, and ?exotic? issues such as forced marriage and polygamy.
